Just read a case where a man got a two year suspended sentence for raping two girls aged 11.
I really dont want to cause offence to anyone on the forum (that's the last thing I want to do) but I find this infuriating.
Just (seems) to me there are no guidelines used in sentencing and because this guy sobbed in the dock he wasn't given an immediate custodial.
Never condoning what my son did and yes ALL these crimes are serious, but I continue to feel the judge took a dislike to my son and the consequence was a long custodial.
is that fair?

It beggars belief the reasoning behind some sentences the umbrella of this crime is massive and needs broken down for sure.

That is a ridiculous sentence!. My OH has sentencing coming up, his solicitor has said it could be 1 to 3 custodial!. Yes he's commited a crime but no where near as serious as rape! And he could go to prison while this man gets a suspended!. Time to scrap the role of a judge. They are outdated, the justice system needs a massive overall and the sentences need to be reviewed!
I would be careful about any sentencing decision reported in the press. They leave out so much of the detail and they seem to have an agenda to undermine the judicial system whenever they can. Every sentence is a soft sentence for them.
There was a case reported in the press a few years ago of a man who raped a child. No mention of the fact that he had autism, ADHD and a learning disability. The sentence was referred to the court of appeal as being too lenient, but the court upheld the original judges decision.

I would also point out that sentencing is only part of the punishment. The press never mention the other things, such as the restrictions on foreign travel, not being able to visit some countries for the rest of your life, the restrictions on internet use, the unannounced police visits to your home for the next ten years, having to disclose to everyone in your life, being unable to apply for many jobs, higher insurance costs, being unable to go to certain places, or do certain activties, not being able to live at home anymore, worrying all the time about your name being googled, by people that you meet and so on.
When I hear people say that someone who received a suspended sentence was not punished at all, it makes me so mad. They don't understand the reality.

I'm right with you on your thoughts on this.
My person has been diagnosed with autism and is now going through assessments for dissociative personality disorder due to childhood abuse but when I mentioned this on this site not long ago I was told by another member that this was no excuse and the courts would not and should not be lenient on my person just because he has autism and maybe a personality disorder.
So why would this be taken into account in some instances and not others, maddening isn't the word

Thankyou Betty, I did write a lengthy comment as I feel very strongly about sentencing and the inconsistency of it all. Deleted it, dunno why! But basically I think a two year suspended sentence for rape isn't right. Yes as Edel said it's not just suspended they will have restrictions etc but they are not in prison! I know what my partner has done is very wrong but I just think the whole justice system needs a shake up and modernising
I think forum users are all well aware of the restrictions placed on sex offenders out in the community.
i know my son will be heavily restricted on release and I agree he should be monitored, there's no doubt about that.
Crimes in this area are so varied, on line viewing, distribution, contact or attempting to meet up with an underage person, the list goes on.
i just feel everything shouldn't be placed under the P umbrella, its just wrong and unfair!

Totally agree Smile, there is no standard at all when it comes to sentencing let alone tarnishing people when there are so many variables. We have such an outdated judicial system that has not moved with the times and there appears to be a reluctance to do so.
