Hi,

Not posted in a while but still waiting on a date for sentencing.

My person was told by someone who'd previously served custodial for this type of crime that upon release they weren't allowed to live back in the same area where they lived before going to prison.

Does anyone else have experience of not being able to go "back home" after serving custodial?

Surely being back home with family support is better than being released and having to relocate to a completely different area we understand the possibility of a hostel for a while but surely they can't dictate where you can live, if it's a house that's owned.

Thanks for any advice.

xx

Licence conditions are supposed to take into account peoples individual circumstances.

If there is a particular reason for excluding someone from an area, to prevent them from contacting victims for example, then that is unique to them.

The only fixed rule is that they must reside at an address that is approved by probation.

Hi, although it wasn't officially stipulated at sentencing, it was made clear that the ex shouldn't move back to where he was when he was arrested because he was well known in the area because he worked in local schools. This was all well and good until he became homeless after release because his house share of criminals found out who he was and kicked him out. He then returned to the original area because someone could put a roof over his head and the Police didn't want him sofa surfing. X

It depends completely on individual licence conditions and the perceived risk associated with each individual. This doesn't apply to my husband but others who he served with already know they will not be allowed back to the same area. It's all dependent on many factors x

Hi,

Would it be because you did whatever you did to someone in the area where you live! And would it apply to communication online only if communication was outside their own area do you think??

Hi Betty, my ex's offences were all online images of no one local and he was informed he couldn't go back to the area where he used to live.
I'm my experience, you either get told a load of bs to scare the cr*p out of you out you get some story told through rose tinted glasses! After my ex was sentenced, the Barrister came to talk to me and my daughter. He told us not to worry, that people mess their lives up all the time, that he'd be out in a few months and then home! He served 18 months of a 3 year sentence in prison and was never allowed home! Unbelievable!
