Hello all,

The solicitor told us that my partner case was sent out to CPS around 2 weeks ago and the officer confirmed they didnt find any additional evidence on the phone (only device they still have)

We asked if we could have it back (we previously got back work phone and laptop) but they said no. Why ? I thought when they send out the case to CPS they concluded the investigation. Why they would still need the phone? I am a bit confused.

How can we be sure they sent the case to CPS? Is there a way to know? How long does it take for CPS to give charges?

Galaxy, I'm surprised that it's not NFA if they couldn't find evidence.

Did he make admissions in his interview?

Our oic has multiple devices left and said we can't have them back even though there's no way evidence is on all based on charges



I think it's in case they need to look for more if the case isn't strong enough

I was just confused why we got the other two devices back and not this one. Do you think they return them back because they were work devices?

Hi, when the police came and took all our electronics, including my kids stuff, we never got a single item back. They took about 12 items, he offended on two which were ordered to be destroyed by the Judge. They said I could have the other things back but I would have to pay an outsourcing company £70 an hour to go through all of them forensically. This would have cost thousands so we lost the lot. My son recently bought himself a PC with his Christmas and birthday money and they took that. They even took his Raspberry Pi. X

Hi,

I was told that they don't give back devices that have been used to offend so if the original evidence was on that device you won't get that back. The judge will most likely order it to be destroyed xxx

Hi galaxy

They took two devices belonging to oh but left a third. His laptop was returned but phone has been kept. Our case is also with the cps now. I'm not sure if he will get it back xx

I got confused because today I called the Stop it now helpline and they told me that if the device was not sent back to us probabaly they were sent to forensic and this might take up to 9 months and that officers send cases to CPS when the investigation is concluded so if they are keeping the phone is because they are still investigating.

They also informed me that it is very strange that the case was sent to CPS so quickly (it took around a month and a half since the knock to when the officer called the solicitor saying they were sending everything to CPS).

Don't know what to think

My OH was arrested, charged and sentenced in three weeks. They did not give our devices back for four months. X

When an investigation (including forensics) does it go to CPS, regardless? Or does the OIC decide what happens next ie NFA, CPS, charges etc?

Rshultzz - i believe when investigation is completed the OIC reviews all evidence and if there is enough they send it to CPS which decide to charge or close the case.

But if the OIC doesn't have enough evidence they can also decide NFA and close the case without sending it to CPS.

Galaxy, I have messaged you as my oh also had no evidence found on his phone but they made a request for the destruction of his device which we decided not to fight.
