My OH has got his court case in less than a month and has been told to get a solicitor. Which is easier said than done. The paperwork he was given by the police suggested to contact the magistrates office to find a solicitor. He has been trying for two days and goes through the options to be told at the end "all our operators are busy", then the line goes dead. He has tried other solicitors but they don't deal with these type of offences.

The bail still stands but they said if he doesn't adhere to the bail from now on, he'll be arrested. Funny they should say that after a year of being on bail. So did the bail conditions not matter before now.

He is at the magistrates court. Will his case be heard at the magistrates court or will it be referred to crown court. My manager said that it could happen. Just when I thought it might be over in less than a month, someone says something that makes me think it won't.

Magistrates courts do not deal with cases where it could result in a prison sentence over a certain amount of time so usually get referred to crown court for the actual sentencing when he makes his plea hearing. Our majestrate court hearing was 20.5.24 and crown hearing 28.6.24. Take care xx

Hi Dawn, magistrates court tends to be the plea hearing when the person pleaded either guilty or not guilty. The case is usually then referred to crown court for sentencing. My son was given his sentencing date at his plea hearing.

As far as solicitors are concerned, my son had already admitted everything when arrested. He decided to use the same firm of solicitors that were present when he was first arrested. He did have to keep chasing them initially but eventually he got allocated a solicitor that represented him at his plea hearing.

Try James McAuley at ABR solicitors. He goes all over the country. I can highly recommend him. He is an expert dealing with these sort of cases.

Ocean, my OH stupidly decided not to have a solicitor present when he was arrested as he didn't want to wait and be at the police station any longer than he had to be.

Dobster, I'll look them up. Do you know if they provide legal aid? I will support him but not financially. He doesn't work and I don't earn a lot.

Hi Dawn, I hope you find a good solicitor my OH spoke to two and decided on the latter his representation of my OH was impeccable.

depending on your case they are usually referred to as 'either way' meaning it could be heard in the magistrates or crown prosecution. You could go to the magistrates to enter in a plea. Be prepared as CPS usually make a point of referring to the crown prosecution it could stay in the magistrates for an all options review this means when he goes back for sentencing it could stay in the magistrates if it is a community order or worst case a maximum prison sentence of 6 months as they have limited powers compared to the crown. If the mags do not feel they have the power to sentence the case they will refer it to crown where they deal with more serious cases. Wishing you the best of luck but I would seriously advise that you get a good solicitor one that you would be happy to represent your OH the rapport makes all the difference

Dawn my OH was given Legal Aid by ABR. You won't find a better Solicitor. James really cares about his clients and their families.

The solicitor above is likely to be your best option if you need legal aid, we didn't use him but he was recommended by a stopso therapist to us alongside one other (who was not legal aid)

With legal aid how do you choose a solicitor ? Do they need to be within a certain distance of where you are or can you choose someone from the other side of the country ?

Need Help - ABR represent people from all over the country. You don't have to choose a Solicitor from your area.

Thank you for the advice.
