Guilty or not guilty

Do you guys think the process goes quicker when someone pleads guilty? Pleading not guilty I would assume leads to a trial. My husband will be pleading guilty so I'm hoping it goes fast and we get this over with. Also what happens after he pleads guilty? Does he get sentenced there and then.
Hi Ashley, The investigation stage, which is the stage I'm guessing your person is in at the moment will be the same either way. It's the investigation stage that takes the time. Once the police have all the evidence they will send it to the CPS who will decide if there is sufficient evidence to charge. The charges are then issued and a date for the plea hearing will be given. It's at plea hearing that the person pleads either guilty or not guilty. If they plead guilty they will go for sentencing and if they plead not guilty the case will go to trial.
My person is my son and his offence was communication, he waited 20 months from arrest to charges, 1 month from charges to magistrates court for plea hearing where he pleaded guilty and 1 month from magistrates to crown court for sentencing.
It's a very long and drawn out process especially when the person admits everything right at the start during their arrest.
If you haven't already done so, I recommend contacting LFF for support and also your GP as you're both going to need to take care of yourselves over the coming months.

Hi Ashley, it usually goes quicker if you plead guilty, but not really as you still have all the consequences of the sentence to follow. My husband was considering pleading not guilty but there are many factors to it the cost, and instructing a barrister, it could be another year and the jurors may not believe him plus all the added stress that goes along with this situation and being out of the family home etc.
These are usually called either way cases meaning they could be heard in the mags or crown court so after entering a plea your oh will likely be sent for a pre sentence report with a probation officer from then they will return to mags or crown court for sentencing. Hope this helps wishing you all the best xx

It does go quicker if they pleat guilty as it goes straight to court for sentencing. If they plead not guilty it can take an awful long time for a court case to be scheduled. With my ex it was around 2 months from charging, then court (where he pleaded guilty) and then a final date. They also like to see more remorse, so a not guilty plea and then evidence that they have worked on themselves goes down well. So my ex did the lucy faithful course and got counselling. I think it did help that he showed remorse rather than wasting a court's time with a trial
