Can someone please explain the bail condition 'to not reside or sleep where under 18 resides or sleeps' as my husband said when he was given the bail conditions the police said he can be at home just supervised around our child which he has been doing but now I spoke to SW and she said he shouldn't be at home when our child is there so I'm so confused right now and scared that he will be in breech of his bail conditions :(

Our oh is at home while I'm here with our 16 year old daughter. He doesn't sleep at home and leaves when I go to bed, but comes back in the morning. We haven't had much involvement from SW except at the beginning, but she signed off pretty quick and didn't say that my oh couldn't be here.

Thank you for your response. Did the bail conditions say just sleep or can't reside there either? I'm just so confused

Hi,

I'm fairly confident that the sw is incorrect. He can't sleep in any place with children and can't reside (live) anywhere with children xxx

The bail conditions states he can't sleep at a place where anyone under 18 lives.

I think its a misunderstanding by the SW about the meaning of 'reside'. If he sleeps at a different address and only comes round during the day, then he is not residing at your address.

The police set the bail conditions not the SW, so only the opinion of the police matters.

My oh has the same conditions but ss have said he can not have any contact with the children at all. They closed the case earlier this week. It's been very difficult for them not being able to even speak to him for the last 4 months, he's not their bio father so I don't know if that makes a difference. They all told the sw how they feel about no contact but their views weren't taken into account
