Changing Bail Conditions

Has anyone ever managed to get the bail conditions changed? I'm really struggling with my child at night time as doesn't sleep that well and wondering whether we can change the bail condition of not being able to sleep where under 18 sleeps.

Hello

im not much help with this but i have little ones and it isnt the police bail thats stopping my OH coming home, his police bail just says to have no communcation with anyone under the age of 18 unless approved by SS.

Its actually our SW that isnt allowing him back home even during the day depsite the SW saying he is no risk and dont believe he has hurt or will hurt any child but they have to consider every possibility until the outcome of the case (which we still waiting for).

My OH OIC basically said he can do what he wants as long as a adult is with him until this is concluded and has his bail address as his home one even though they know hes staying at his parents.

i think it depends on your persons OIC. From what ive read they very rarely change bail conditions unless they think it will beneifit themselves rather than family lives. Personally i dont think they take those around our person into consideration esepecially little ones.
if your person has a solicitor, maybe that could be the person to possibly approach. If not the stop it now helpline may able to offer you some advice.

have you had Contact from a Social worker? what have they said about sleeping arrangements? has your person had assessments etc done?



Fingers crossed your able to get more advice on this, and keep your head up high. This is a hard situation to be in to start with and then add our little ones too it and the pain and the worry for them just heightens too. always a pm away if you ever need to talk

I'm really sorry but it's highly unlikely you will get bail conditions dropped or reduced unless you get a solicitor to challenge the police about the current conditions being unlawful.

If your OH's offences are online then any conditions about non contact actually are unlawful but the police don't seem to care. We went down that road with our son's solicitor but the police said categorically no to her letter requesting they dropped the no overnight condition and next step would be the solicitor taking the police to court about it. She said she would win but it was going to cost more in legal fees plus we had no guarantee she would actually win. Also we knew that children's services would expect the conditions to stay in place as part of their safety plan so although we could ignore them we didn't want to do that and make life difficult in another area.

I'm so sorry that your children are being so badly affected, it makes me so angry how little the police consider the trauma for all the families involved.

It's highly unlikely I'm afraid. The SW will want to protect the child at all costs, that is the priority. X
