Admitted in interview but not on phone

Hi, still very new here.
The knock happened and they said they had information from the kik app about a photo.
he admitted in interview it was sent to him on a chat but wasn't downloaded. He deleted the app soon after.
they've seized his current phone but it happened on a previous phone more than a year ago.
he claims it's an honest mistake that someone sent it him.
what happens if there's no iioc on his phone. Can they charge on his admission in the interview?

I would say that the most likely outcome here is a caution. Without the image, a prosecution is very difficult.
