Hello everyone,

Is it standard practice for mosovo or probation to go above and beyond restrictions ?

"we" have no physical conditions, all are device related, and SOR only requires notification for over 12h or overnight spent with anyone under the age of 18.

However we are being told, we can't see family or friends with children, in a pub for example, or join a gym if gym provides kids classes.

Neither example above is t&cs of the premises.

Please help me understand it any advise on how to respectfully challenge it, without risking breakdown of brand new relationship/working together ?

Hi Flower, that doesn't sound right to me. My son has a 'no unsupervised contact with anyone under 18 years of age' restriction and yet he's allowed to join in all family activities even though there are children there. In fact I would go as far as saying that there really isn't much we don't do. He has 2 children who spend weekends with us (my son moved back in with us following his arrest) and we take the children out and about just like any other family. The only difference is that rather than a family of 3 (son and his 2 children) we are a family of 5 as my husband and I provide the supervision.

This is what we have been told too and have had to abide to for the last two years to avoid disclosure.

This is what is happening with my son. Nothing in his shpo about no contact with kids under 18 but his PO and mosovo making him disclose to parents if he wants to attend family events etc. When challenged they said they can put extra restrictions in place if they feel it's needed!! The shpo is just a guide

We had the same thing said when I questioned about family events. We were told funerals were exempt but anything else they would need to be notified. I'd already told them that we had disclosed to any family members who would be there before it hit the media so it wasn't anything to do with disclosure.
I emailed his offender manager to ask if he had any conditions beyond SHPO and usual SOR notifications and didn't receive a reply back. Presumably to avoid having a paper trail of unlawful restrictions.
My partner just doesn't attend events at the moment but in all honesty they're that stretched that they wouldn't know anyway.

Email them asking for clarification xxx

The SHPO is not 'just a guide'. It's a court order and the police cannot add to it, without going back to court and getting a judge to agree to more restrictions.

The one power they do have, which they don't have to go to court for, is disclosures. So if someone wanted to join a gym, for example, the police could disclose their conviction to the gym owner. But other than that, unless the SHPO specifically forbids contact with under 18s, the police cannot stop that person from joining a gym.

It's really frustrating as we were happy with not seeing those physical restrictions on SHPO only to be slapped with them unofficially. I am at a loss.
