Hi,
Can anyone advise on pre sentence report being done by probation? When do they get done and how soon before sentencing?
I understand they're mandatory and without a report sentencing can be adjourned, is that correct?

Yes it can be adjourned if not completed in time. This happened with my son and it's awful, as it just prolongs the whole thing. Get your solicitor to chase it up so it's completed in time x

My sons probation report was done two weeks after pre hearing
Had a crown court date a month later, it was postponed, then rescheduled, even though report was ready
New crowm Court date 9 th July
But not given a time got to ring up night before so it may get rescheduled again

My sons pre sentence report was done by probation a week or two before sentencing.
Thanks everyone, we're waiting for pre sentence report and not sure how it works.
Does the pre sentence report actually help, does the judge take note of the report and is it actually done to help the offenders?

The pre sentence report advises the judge on whether probation believe the persons offence can be managed in the community. Probation cannot recommend prison so instead do not recommend a sentance to be served in the community if they don't think it's appropriate.
Our son's pre-sentence report was sent to the solicitor 24 hrs before court. It appeared to be fair & enabled us to get a more rounded picture of what was happening.
Unfortunately today,they were not supportive of him remaining in the community under their supervision & he was remanded in custody till August Crown Court.
He had attended every appointment,carried out all Community payback & followed all their rules.

It can most definitely sway a judge.
The judge in my OH's case said that he wouldn't usually go with the pre sentencing report and would make his own decision based on the evidence, however he was going to go with everything the report said on this occasion.
He stated it was one of the most eloquently written pre sentencing reports he had ever seen and that he was confident that he would never be seeing my OH ever again in a court room.
We only received it the night before court but it was extremely positive towards my OH. His probation officer now only sees him monthly too as they have deemed him low risk. His meetings are less than half an hour long also as he is doing everything he is asked.

Ths police are trying to prove he has breached his SHPO, by claiming he di not advise the of an old Dropbox account. He has been under Probation supervisision for 6 months but they felt that was not enough. Magistrates court appearance very rushed within 24 hrs,so little time for preparation. Not even sure that his own Probation offer wrote the report!
