Hi all, my OH was arrested end of March 24 and has just been called back for a second interview.
My OH is adamant that there is nothing surface level on his phone, I had access to this and regularly used it at all times of the day and unprovoked.
He has told me and I have seen that he used to chat to women online, through legal swingers sites and they would often end up chatting through Kik and Telegram.
I have seen these conversations and although they are not great, it was never anything illegal.
He says that on occasions, women would send porn or pictures of themselves which he would not ask for, and I can confirm this and he would delete straight away as he was not interested in anything more than chatting about non-illegal stuff.
We have both gone through iCloud, emails and everything since the arrest and cannot find anything illegal at all.
The OIC has said that after the second interview, he will "you will be bailed back out at which point my Sgt will decide whether we approach CPS for a charging decision or not.".
My question is, has anyone else had a similar situation where there was nothing surface level and if there was anything, it had been deleted the moment it was on the device.
The issue is that we have previously worked through this, him messaging other women and I thought we were doing much better, but this all came about from something that happened years ago. Through research and being told by our solicitor who has another case with the same country that this will likely be over a year and therefore with our wedding early next year, we planned to still go ahead with this.
However having now been invited back for a second interview, does this mean that charges will almost certainly be bought against him? Does anyone have experience of second interviews resulting in NFA or a caution?
I may also be reading too much into what the OIC said, and we all know not to trust the police but is seems like they are unsure to send off the file to the CPS or not meaning they must not be confident in their evidence.

It's really difficult to know what might be found deeper in. Your person could have clicked on a site that didn't show outwardly it contained illegal content but it still downloaded. They could have received a picture of someone they believed to be an adult and the police age them a child (rightly or wrongly). Deleted things usually come up when they dig deep enough.
As far as I'm aware they send to cps for them to decide on charges and whether there's enough to change so in some capacity it will always be sent off to them.

It seems from what you have said that the file will be sent off to the CPS after the second interview.
It seems so harsh that our lives will be turned upside down for a mistake in that my OH was sent things without his consent and deleted them immediately.
Does anyone have experience of a second interview then receiving a caution or NFA?
