My OH was in magistrates court on Thursday where he entered a guilty plea. He was accompanied by his solicitor who was from the firm of duty solicitors who came to custody when he was arrested.

After the hearing, the solicitor advised OH that he was looking at a community order when he is sentenced later this month.

But I am not sure this is right.

According to sentencing guidelines that the judge has to use, possession of category A is a minimum charge of 26 week's custody.

Is the solicitor correct and he could end up with a community order instead?

In reality there are two likely outcomes, although nothing is certain, because the sentencing guidelines are just that. They are guidelines and the judge can do whatever they want.

The most likely outcomes for image only offences would seem to be either a suspended sentence, or a community order. It's not really clear why judges choose one over the other, but it does affect the amount of time they will spend on the SOR.

If it's a community sentence then it will mean 5 years on the SOR, but if it's suspended then it will probably be 10 years.

My person has a.b.c we thought it would be prison but he got suspended, community service and fine 5 years sor and shpo. Every outcome is different and it's all down to judge on day. The one mine had didn't even let solicitor speak , they started and he put hand up and said it wouldn't be a custodial and solicitor said do you want me to carry on and he said no. We was in and out within 5 minutes

My oh was category a and it was no shpo, 1 year sor, 1 year supervision and 180 hours community payback

My OH was making all categories, also extreme and prohibited. He was given 12 months suspended, 100 hours unpaid work and RAR for 24 sessions. 10 years SOR and 7 years SHPO (online restrictions).

CPS and our solicitor both agreed on suspended sentence to the judge, although the pre sentence report recommended just a community order.

Every case is different x

Hi, my person was sentenced to 3 years in prison for IIOC, first offence. There's so much that goes into it. My advice would be to go prepared for the worst but hope for the best. X
