Hi I'm hoping there's someone out there that can help . My husband has been charged with 5 cat a 1 b and 5 cat c of which where added into a group chat on kik he did not ask for them and did not pass them on . I was wondering if anyone's case was seen at magistrates and didn't go to crown ? Thanks

I have been advised that no magistrates can deal with these crimes. All to crown.

My OH never went to crown. I think it goes to crown if the sentence could be longer than two years, though this does not necessarily stop it going to crown, as magistrates only have limited power. Hope this helps. X

Magistrates tend to pass cases where the prosecution thinks a sentence of more than a year is a potential (including suspended sentences). Having a catagory A image would almost always mean it would be referred to Crown Court. Someone who had a handful of category C images could easily be dealt with by magistrates. Going to Crown court isn't an indication that someone will get more than a year, but that the crime is so serious that it is a possibility depending on the aggregating and mitigating factors.
