It depends what they are investigating and what evidence they already have. If there are accusations of a chat, then they may have one side of the conversation already, from another person's device. If it's images then they may have an ip address, but if they cannot find any images on the device then it's hard to prove the images were ever received.

But images are very often recovered after being deleted, because they exist in the cache and sometimes are backed up to the cloud as well. Thumbnail traces can also be used to prove the images were there, even if they have now gone.

So unless the person has a very good understanding of computer forensics and knows how to cover their tracks, then the police can recover deleted images fairly easily.
