My OH received a phone call from probation today and they've arranged for him to see them in a few weeks. Can anyone advise what to expect. Does he need his solicitor with them? Do I go with him to support him?

Is he between plea and sentencing?

If he is, he is being met with to write the Pre-Sentencing Report.

you wouldn't normally take legal representation with you, but it almost definitely worth asking his solicitor what he needs to bring with him.

the PSR then makes recommendations to the judge regarding sentencing

Hi Dawn, my sons pre sentence probation meeting was done via the computer through a Microsoft teams meeting. The probation officer asked him questions about his life, what he thought had led to his offending, his thoughts regarding what he'd done and any steps he had taken to change his behaviour and reduce his risk of reoffending.

The information gained from the meeting was used in the pre sentence report including their opinion of whether the sentence could be managed in the community and any recommendations.

My son immediately admitted his guilt during his arrest and was full of remorse. The judge made reference to this in court so I'm guessing this may also have been included in the probation report.

Hi Ocean

We were told that it would probably be over Teams, so I was surprised when they arranged for him to go in person.

The judge wants him to say he is attracted to children when he speaks to probation, which is not true at all (he won't even change our granddaughter's nappy), so I don't know how he will handle it if it comes up. I'm nervous he will say the wrong thing and the judge decides he deserves to be punished by going to prison.

Dawn, he just needs to be honest with probation. My son doesn't ever remember probation asking him if he is attracted to children but his ViSOR does ask.

Being attracted to children isn't a crime but acting on it inappropriately or illegally is so I'm not sure it can change the outcome either way,

My son was advised by his solicitor to be honest in his pre sentence meeting, to take accountability for his actions and to make sure he didn't minimalise what he'd done.

I completely understand your anxiety as so much seems to rest on the pre sentencing report.

My son's pre-sentence report was initially a shock as it gave more details than we knew.

However,we thought it was fair & a clear insight into the way he was thinking, leading up to his offences.

We now realise that it all followed on from the way he felt after his beloved grandfather died. The pandemic isolation was added to this and the pornography websites beckoned. They were a world away from the lonely life he was living & raised the endorphins. This is no way excusing his behaviour or offences but we are starting to understand why.

Hello.

Don't know if I could shed any light on it.

We had a phone call in between the courts. The probation stood in on his Magistrates court hearing and then they rung him up and I was in the car and they just went through random questions and then he asked what would they reckon or recommended to the courts.

They said to my O/H a suspended sentence which he got and a community order which he got.
