DBS - Advice

OH has been with current employer for over 6 years, had to do basic DBS in beginning. Does not need to disclose. However, he has been convicted (suspended) so has been able to continue employment.
He does not work with under 18s. His company has since lost the contract and he is now being TUPED over.... The new company says needs to do basic DBS check. Can he lose his job?

oh no what a worrying time for you. I guess it depends what their policies are regarding offenders; could he check out the TUPE conditions agreed etc with a union rep or HR person without disclosing? or try the new companies internet for employment policies? My person still hasn't been charged, doesn't work with children and has previously and recently (and still can) pass a DBS check. However at time of arrest he was new to the role in probation period and it was internal policy that you let them know if you're arrested in case it brings the company into disrepute. He quit before they sacked him/found out. It would also affect references. So he left and is job hunting hoping he doesn't have to disclose....until he has to (if that makes sense).

Nothing saying about disclosing anything! He's sent off the DBS with this new company so just waiting for an outcome now....
Basic DBS covers unspent cortions and convicitions, so I'm afraid if he is still on the SOR or SHPO it will show it's only spent when you are off the SOR and SHPO.
A SHPO or equivalent means a sentence can't be spent until that ceases but just being on the SOR doesn't affect whether or not a sentence becomes 'spent'
He's only been freshly convicted so it will defo be there. He is on SOR and SHPO - will it specify what he has been charged with? Eg) making category A or something along those lines?
I don't think that will refer directly to the actual details of the offence but will state that it is an offence under section...( sorry my mind has gone blank as to the section number)
I just did a Google search and found a basic covers unspent ....I thought it didn't. This worries me because my person is wanting to change jobs next year and I'm not sure how many companies require DBS checks. His current role never asked
I feel dbs should only be for gov roles or working with vulnerable people. But I think some companies just do it regardless.

It's not just the DBS that is problematic it's the standard question and declaration as to unspent convictions that also causes a barrier. It seems to be across the board irrelevant of role.
Sometimes if you work with bank details, handling money or finance they'll do a DBS to check for fraud....but it'll pull up everything else.
