Hello Everyone, it's been 5 months since the knock and life just seems to be at a stand still :( Trying to keep things as 'normal' as possible for my 13 month old but knowing we have a long road ahead. I'm just looking for some advice, so the police told me that my person had sent a cat b image to someone that flagged up on his account. That is all they have told me and nothing else, computer and phone taken and just waiting. My question is my person was convincted of an unrelated offence 8 years ago and was put on SOR for 10 years (judge was very harsh) he is obviously still on it now but when this all goes to court will that go against him and would they increase it to indefinitely on the SOR if he is convicted? I understand every case is different and 1 image is one too many but if it is just 1 image what would we expect in terms of conviction?

Sorry you're joining us here, I couldn't just read and not reply but I've not got experience or knowledge on re-offending. Hopefully someone else will be along to help.

If he has an SHPO that is still active then he could be charged with breaching that, which carries a penalty on its own.

But his time on the SOR would restart with any new sentence, so he might get another 10 years on there, if it is a suspended sentence. An indefinite period is unlikely though, because the new sentence probably won't be long enough.
