Hi my husband was initially told there was only 5 images no cat a but after forensics they found 5 a 1 b and 5 c it was all via Kik he was in a group chat and someone put them on he didn't ask for them or distribute them but he is getting sentenced in 2 weeks for them x

The situation I'm 'involved with' hangs on deleted images (IF he's telling the truth - he may not be) and my understanding from the solicitor, who specialises in this area, is that the whole question of deletion is really complicated. There are a lot of factors involved in whether something can be recovered or not. So no, they can't necessarily recover everything. But you very much can't assume they won't either. I know thats not a very useful answer! Also deletion is very much not a 'get out of jail free' card, though I understand it can be used to mount a defence. You can also get your own independent forensics done to support the case, if thats something you want to pursue.

Just to add, the solicitor in our case says that if the devices are clear thats almost certainly an NFA.

Molly Dog (or indeed if anyone can answer my question) can I ask at what point those forensics happened? Was this presented to your person at second interview prior to the file being sent to CPS or was it at the point of charging? I heard my OHs barrister mention something to him about awaiting results of the full forensic, but we just felt a bit unclear as to when that's carried out and since then his file has been sent to CPS. Thanks in advance!
