Police decoy vs human being

Hi.



I was looking for some advice on people who have gone through a family member/friend who was charged with sexual communication with a police decoy.



I have been reading that people who were caught via police decoy have been charge with attempted communication, however, my family member has nothing on their charge sheet regarding 'attempt'.



should this be something we question? Should it be stated as attempted due to this being a police decoy or does it just get treated the same as if it was a child?



I hope this makes sense.

Possibly. Just checked my persons and it does say attempt. Maybe ask the solicitor?

It should be attempt if it was a police decoy or any type of other decoy

My OH had deleted the kik app prior to being arrested and so don't actually have any evidence of the conversation being on his phone, so they can't charge him for that. They found 9 images (which they can't see fully but 'think' they look like cat b) all deleted but found in his cache - so are prosecuting him for that.



My mind is blown about how little evidence is needed to prosecute. It makes me think, you could probably run a forensic on any man's phone who watches porn and find a similar level of 'evidence.' This is why 'making' is preferred by prosecutors, so much each easier to get a result.
