we got the knock in July, we are just over 6 months since this began. My OH made a mistake and accidentally downloaded a file with a bunch of links in it, one of them was a link to a porn site that included IIOC as well as legal pornography. A family member contacted police after I asked for advice having found this link and we have been going through this fresh hell ever since.



there were no photos or videos or anything downloaded to the computer, it's a shared computer that I had access to along with everything else. I just have some questions for anyone who has been fortunate enough to have an investigation NFA'd.



does the investigation still get sent to CPS/prosecutor fiscal even if no evidence was found in devices? Did you get proof of the investigation being closed?



I spoke with the OIC last week who said they are still waiting for the analysis to come back from the cyber team but are chasing it every week and it should be sooner rather than later. I'm praying for something this side of the year but you know what it's like.



I have family members who have spread information to people we did not want knowing this was going on and I really would like proof the investigation has been closed so we can get this put to bed and my family can stop harassing me.



a family member is also claiming to have spoken with the OIC and got information but I am under the impression this is not possible due to data protection and GDPR laws?

I'm similar time frame for you in that we had the knock in July, but also feel we're similar situation in that we have been told we're getting all devices back except a laptop which hasn't been downloaded due to it refusing. (We haven't had the letter to get stuff back just yet unfortunately but know it's coming!). My partner was also not arrested or interviewed etc just a warrant issued to seize items



I work for the police so understand some of the processes. Re CPS- I'm not 100% sure I think if there's no making/distribution OIC can make the decision.



If it's NFA'd he should receive a letter stating this from the force which would be proof.



I was the same chasing devices- our OIC was able to do a lot of downloads himself, but the laptop had to go to forensics and been told it'll be another few months at least despite being 6 already.



Family's a hard one, and I've been very lucky that those who know what's happened with us have all been supportive, I know it's not always the case and I think it may have been my selectiveness of not telling certain family anything.



Re the OIC speaking to your family, the only way he could do this is if there are bail conditions your partner has that affect them/their children. The OIC should've spoken to yourselves before sharing ANYTHING though, so I would ask the OIC what the conversation was if there was one.

Hi, our experiences with the CPS before and during court appearances was one that seems very similar to many, and also referenced by the judge. They are not particularly organised.

We were contstantly on the phone in the early days to the police, but after we were advised this offence has increased the demand for the team we decided to simply wait. Really not easy. Then finally 6 months later the arrest and letter that followed confirmed what had been found.

The accidental downloading was something we spoke with my sons solicitor at length about. He has since pleaded guilty as his barrister confirmed proving they had been accidentally downloaded and then subsequently seen would be difficult.

I hope you soon get the response you are looking for and can move forward.

Thank you both for your replies. My OH wasn't arrested, just a warrant for devices to be seized and a voluntary interview so no bail etc. Just pending investigation.
