Knock was 10 months ago

Court bail hearing was 9 months ago

lawyer is waiting on cyber report as there is a backlog

Lawyer told my person that they have a year from the day he was arrested to charge or drop the case. It's this correct?

No that is not correct. Hence why you see cases on here dragging on for years, our case took 30 months in total x

No that is absolutely not correct and I'd be worried if your lawyer actually thinks that. There IS a limit on how long they can keep bailing suspects (is that what the lawyer meant?), but there's no limit on how long investigations can take. The suspect's status just changes to 'released under investigation', which does mean the police can no longer impose conditions. Sorry! The case I'm involved with has already clocked up 15 months + waiting on forensics & the lawyer (a specialist who only takes these cases) isn't at all surprised by that. I'm sorry to be the bearer of bad news

I'm Scotland also. It's hard to know what to believe isn't if. It's a horrible and confusing situation

We are In Scotland and 8 months post sentencing. I don't know the answer to your question as the investigation stage was only 4 months from Knock to charge.

This has been difficult to answer, although I think the solicitor might be confusing it with the 12 month limit between charging someone and it going to court, which does exist in Scottish law.

But I have seen no evidence of there being a 12 month limit for them to bring charges.

I'm afraid that's not correct. My person was arrested in 2019 and charged in 2024.

I hope few other people have to wait as long as he did.
