Working whilst under investigation/ convicted
Notifications OFF
My SO is currently being investigated and on bail. He's been let go from work. What experience do people have of their partner's finding work/ employment while under investigation (and afterwards)?
I don't understand how it works with regards to criminal records and how this is shared with employers either- the internet keeps giving me conflicting information.
Any help appreciated x

He can essentially do whatever job he likes at the moment because he does not have a conviction. It may show up only on an enhanced DBS check that he has been arrested but all other forms of criminal records checks should come back clear for now. So obviously regulated professions like teaching, nursery care, wokring with vulberable adults etc are out of the question. You would usually be notified before a DBS check is carried out.
Most employers do not actually check or have access to criminal records even once a person is convicted. Vast majority of employers do not actually use DBS because it costs them to do so. But you are legally obliged to disclose an unspent conviction only when asked either on the application form or in interview etc.
For now, he should be able to find a job without much trouble. The police would only disclose to the employer if they feel there was a risk of him committing an offence. Obviously, if his bail conditions prohibit contact with people under a certain age, that is something to consider.

Hi, my son returned from the armed services almost three years ago and sentencing is to take place in March.
in regards to finding a new job, from his experience the majority of employers asked details of any convictions and also if he was under investigation at the time of application.
When a job was secured with Starbucks the police informed him following his guilty plea he had to leave as they employ under 18's.
There is some really helpful information online regarding businesses that no longer require you to confirm at application stage details of convictions, however confirm they expect these to be disclosed if interviewed.
I can confirm too, I work in the finance sector and we have annual criminal record checks. As discussed each search can vary, basic, standard, enhanced and enhanced with the barring list.
Good luck, I hope he finds new employment xx

My person waset go when under investigation. But found employment easy enough because most places ask for convictions, and not many ask if under investigation. Your person will need to check wording of the job application and job contract.
My person didn't have a clause in his contract to say he needed to disclose if convicted when in employment. He had to turn some projects down due to DBs check request. His company never asked why he turned down projects thankfully. He worked in construction, and tbh there were a few he worked with that likely had offences of a range in nature.
