So seeking advice and information.
We have had a holiday booked to go America for the past two years.
My son has attended voluntary interview back in November and as of this week we are still waiting for his case to be presented to CPS.
I suppose what I am seeking is would he still be able to travel with us? At present he is not subjected to any restrictions, I have asked OIC but haven't received much of a helpful response. We are on the cusp of cancelling but also feel that this may be our only chance of one last 'normal' holiday if he does get put on SOR/SHPO. I then also worry if we chance it and he gets recalled whilst away this could also affect his case.

do you think he'll be convicted? If so, depending on the timeline - although that's hard to predict - I'd be cancelling the trip. I'm sorry. X
The OIC has said its likely to result in a conviction due to evidence being on his devices.

We were in the same position. We had a holiday to Florida booked and we had to cancel xx

If it's allowed I would definitely go would be good respite for a little while for the whole family.
If he is RUI then he has no restrictions on leaving the country. If he is on bail then he needs to check the conditions.
It typically takes about a month from being charged to the first court appearence, so depending when the holiday is booked for, he should still have a chance to cancel if he needs to.

Has your son already applied and received his ESTA? If not then this might be your stumbling block if it uses words like 'arrested' rather than the more specific 'convicted'. Whether things will progress between now and your planned visit is also worth considering as nobody can predict timelines at the moment. It's also not true that your son will never be allowed to got to the USA although he will have to apply and be interviewed instead of just getting the ESTA but there are solicitors who will help with this.
It certainly takes the gloss off planning a lovely trip like this but only you know how this uncertainty would spoil the planning and maybe even your time actually there.
