Hi there,I'm reaching out to try and put my mind at rest but I'm not sure if anyone will have the right answers for me. I have a 12 year old daughter and 18months ago her dad(my ex husband) was arrested for being involved in a chat group where there was lots of explicit talk about children and lots of ii shared. Since the forensics have now finished with the devices I have been told there was over 300 images/videos on his device,I don't know if they were shared or saved but all I have been told is they are over all 3 categories. I guess what I'm trying to prepare myself for is if this is likely to be a custodial sentence. I hope someone replies and hopefully soon this nightmare will all seem a little easier. This is so tough trying to be mum and dad for my girl. She doesn't deserve this and I am trying everything I can to make life as good as it can be right now while she isn't seeing him.
It all depends on the judge at the end of the day, but statistically an immediate prison sentence is unlikely for an image offence. The most likely outcomes are either a suspended sentence or a community order.
I guess it could come down to whether he shared the images with others or just received them as a distributing IIOC charge will have a harsher sentence than a possession/making IIOC charge.
