Hi all, im new & struggling. My OH was arrested nearly 2 year ago, spent a year on bail then placed on RUI, a few months after he got called in for a voluntary interview (not relating to the other case) after this he received a letter saying it had been sent to the CPS. We haven't heard anything since, I'm struggling with the waiting and not knowing, they took his phone for analysis & DNA swabs this was nearly 2 years ago we haven't heard nothing since, anyone else had this?

Hello Stitch
Firstly I'm sorry you find yourself here. Unfortunately whilst the average wait on a charging decision is around a year to 18 months, a two year plus wait isn’t all that unusual, I think in most cases the delay is waiting on devices to be analysed, with digital forensics being used to provide evidence in so many cases now the backlog in some police forces is huge.
Moving from being on bail to release under investigation wont necessarily help, there’s no longer any onus on the police to deal with the case in a timely manner like there would be on bail so the case goes to the bottom of the ever growing pile.

The time taken to examine devices varies between police forces and after a lot of FOI requests, I was able to establish that this is not the only source of delays. The Met for example, take around 260 days to check devices and that is longer than most forces. The biggest backlogs are Police Scotland, Kent and the Met. There are also delays once cases are passed to the CPS.
The average time for an investigation to complete, pre covid, was 514 days. I have not seen the numbers for post covid, but I expect it has gone up since then.
The really long delays of more than 3+ years, are most likely caused by the OIC leaving the force or moving to another job. That is where paperwork seems to just go missing, because nobody else takes on responsibility for it.

Thank you for the replies (: I assume the phone analysis is back as when he went in for a voluntary interview they had found stuff in his iCloud from 10+ years ago stuff that got sent in a lad group chat /: (of course it wasn't the best of stuff to be found)
nothing has been said about the original case, SS signed me off 3 month after the alleged incident and I haven't heard anything from them since either, it's like we're just put in the dark. Living in a small town and being buisness owners is making it hard, luckily he's had unreal amounts of support and love from people who know him deep down.
