Bail being extended to 18 months

has anyone else's other persons bail been extended to 18 months? I thought that after 12 months it turns into RUI and bail conditions are gone? I'm so confused if this means it's more serious.



Anyone had anything similar?

Hi fearful, we have just had the same thing happen to us, we're currently at the 9 months point. The OIC not only asked for 12 months, but instead asked the magistrate for 18 months. It was a big shock to us all as the last time my OH answered bail in January, he was told that they were nearly there!



We have asked the magistrate for a bail review to see if his conditions could be eased, mainly because his daughter is suffering due to his absence - her school work is suffering, she is struggling mentally and has shown signs of an eating disorder due to all this stress. Hoping they might consider this...

He is due back to answer bail this Saturday, so we may find out then. It is such a long wait in limbo land isn't it?

Hi Fearful, the same happened to us. The police have to apply to the courts to request the bail extension beyond 12 months. Our police put the application in late and it wasn't granted, but seemingly nothing changed that much, and he wasn't moved to RUI. I was equally confused. Don't worry about severity of the situation I think it's got more to do with it being such a lengthy process ....good luck xx

How do you mean nothing much changed after the bail extention was refused?

As I understood it if the bail extention isnt granted before the current period on bail ends then the bail stops being enforcable and any conditions set by police become void.

In theory the bail can be extended by the court indefinatly, as long as a magistrate agrees the extention. Majority of cases it seems go RUI after 12 months but not all (presumably because the police dont want the hastle of going to court every three months)

The problem with going RUI is that Social Services can still expect certain safeguarding 'rules' and although you can ignore them and the police wouldn't arrest you, you do risk SS starting to consider proceedings as they could consider your children are now at risk with no bail conditions protecting them. Because SS go on risk rather then proof and it's impossible for them to prove definitively that someone being investigated for these offences is no risk, you can't win.. This is mainly when there are children in the home and if that's not the case it is preferable to be RUI as you don't have to overthink things whenever you go out and you can go on holiday etc. The above isn't what always happens but it did for us and the only good thing was the awareness that the police weren't lurking under every bush wanting to catch our person out!!!
