So, in short, my son has lost his job, a career that he studied at uni for. So devastating! But trying to push forward and keep him employed.

He has gone back to his previous zero hour part time role to keep his hand in employment and keep some belief in himself intact.

But now, we are trying to encourage him to get another job, we have sent in some applications some for an apprenticeship as he is very early 20's.

My question is did you or do you have to disclose anything to prospective employers? He is currently on bail, with no confirmation of what is coming next, however likely to be a charge of communication. But as this stage there are no charges. I feel dishonest, but he needs employment.

Whilst under investigation I believe he would only need to disclose if the job involved working with children or vulnerable adults or if the contract of employment specifically states he needs to disclose being under investigation.

If convicted he would need to disclose the offence if asked by his employer or any prospective new employer until the conviction is spent or in certain circumstances indefinatly if the job is exempt from the Rehabilitation of Offenders Act.

If convicted, he only needs to disclose if asked.



Unlock have a list of "ban the box" employers who don't ask about unspent convictions. Some companies also mention this in their adverts too.

Hi, in our experience this is not quite true. His visor or probation officer make the decision as to whether there should be disclosure which largely depends on if there could be anyone under the age of 18 working for a company. So for example, if he went for a job in retail or if the company offered apprenticeships or work experience . Also not allowed public facing jobs in our experience.

This was when my son had only just turned 18 himself

However, our experience is also different as he was convicted pre-18. As your son has not yet been convicted, in theory he could apply for anything but once convicted it's based on checks/balances with risk at the forefront of any application based purely on our experiences. As soon as he disclosed he was not taken on, even if he had got to second round etc, and they were very honest that it was based on risk and insurance
