Scotland. Two teens in home
CJSW (for hubby) and Family SW (who closed case until case outcome this May) came to see me. They wanted to know my understanding of the charges etc. I told them what I knew. They then made out there was more to it. Now, I've heard everything from the lawyer when attending with hubby as I wanted to know what was happening, and what was mentioned during the visit has never once came up. Apparently he sent questionable images amongst adult images he got on Google and P sites (police confirmed this also as has the cyber report) Family SW also claimed he told her he would plead not guilty (he never once said this)
He is in court next month.
I guess what I'm looking for is people's experience of what happens after the hearing. So if it's community payback order (which has been mentioned to him numerous times) and SOR, can SW stop him from living here as this is what they want to do? If the judge deems him safe to stay here can SW go against this? Even on the day he was arrested the police said he wasn't a threat to anyone!!

I'm just sharing things from my experience. SS are a law to themselves and can impose what they want and use safeguarding as their reason. My OH received a non custodial sentence, not on SOR or given a SHPO, bail conditions were lifted in June 2024 and the judge said to him that he can return home. SS will not let him return home as they work on the basis of probabilities and ignore all the legal side of things essentially if it isn't in their interest. I'm having a right battle with them it's awful xx

I don't think they should be allowed to do against the legalities! If a judge makes these decisions they should not against this. I hope you're ok.
In my experience, SS's will say ANYTHING to get you to comply with what they want as it makes their lives so much easier. Your comment of "there's so much more to it" is a line I've seen on this form time and time again. Its obviously in their manual and a downright lie!! X
SW have no legal authority. They would have to go through the family courts to stop him living at home. The sentencing judge will not make any decision on this, although they could impose an SHPO with conditions that include supervised contact and make it a condition that the SW agrees to that contact.
If that happens, then the SW would have more legal power to interfere, so it is important for his barrister to challenge any SHPO.
