Conflicting information

Not sure of this 100% belongs in here so apologies

My husband has his court date this month at the sheriff court (Scotland). We have had so much conflicting information. I know I have posted about them separately but I really want to get it all down on one post so I can come back to it and so I can also get others experiences/advice.



The knock 2024 - the officer (who I assume was the OIC) kept asking had he accidentally stumbled across the images and repeated this over and over.



April 2024 - SW told me we will never be a family again. That he would never be allowed to stay with us again and forced me to keep him away. He was allowed to visit though



August 2024 - lawyer told him to move back home. His bail actually had our home address and he should have been staying here. He told the court that SW kept him away. Court was very understanding and contacted SS. We got a new SW that week.



December 2024 - SW said they had a meeting planned to discuss safety of the kids with him being at home.



January 2025 - SW closed case until we have an outcome.



March 2025 - received date for preliminary hearing. His lawyer said he was 70% sure no prison time. Then said he was on the fence and to bring a "just in case" bag to court. He also told him to pleas guilty.



April 2025 - bail conditions to continue as normal. He saw a CJSW for background report. Police visit house once a fortnight to check his phone. This is where it gets weird.



SW and CJSW attend home. Family SW claims husband told her he was pleading not guilty and that his lawyer told him he would get away with it. This was never ever said (i was always in attendance when she visited.) Then she went on about how he would be on the SOR for 2-3 years, wouldn't be able to do any normal activities etc. She was awful. The CJSW looked a bit confused but I can't help but think it was all said to try and get a reaction and for her to see he had support etc. then the family SW said she can help me tell the children in an age appropriate way what he's done. They are teenagers and both have known since day one as they were there when he was arrested. The police on their last visit said his charge was different to what was said in court and then said that he was using PayPal to make payments. PayPal was never brought up by the lawyer, never mentioned in the cyber report and never mentioned in court. CJSW isn't recommending prison as it would be detrimental to the family and because of how he came across the images (she confirmed it wasn't wanted or asked for as did the cyber report). She is recommending supervision order with her to do programmes about being safer online etc. she is also recommending Community payback order. It could be both and doesn't believe he belongs on the SOR. She also said if it's the above outcome then bail conditions still apply and he must stay at this address.



how are you supposed to get your head around everything when you constantly get conflicting information

Hi, I can't offer much other than to say that SW's will say ANYTHING to get you to comply because it makes their lives so much easier. They simply cannot say that something will NEVER happen etc, I mean they can say it but it's nonsense. I'm a bit perplexed about the comment that prison wouldn't be in the family interest. It matters very very little whether it'll affect the family or not and is unlikely to affect sentencing. Your situation certainly sounds complex. I'm sure someone else here will be able to advise. thanks for replying.



My hubby was sent adult images and iioc were amongst them. He was absolutely horrified. The knock came not long after and the horror started. They said that day "did you stumble across it accidentally" more than once. The cyber report shows he did not ask for it and did not want it. The majority of the images were lowest category (37). 3 were cat A. There was no contact with anyone under 18 at all. It's been awful. The CJSW said there is a rise in cases like this. Unsuspecting people being sent iioc among photos of adult ones

My ex downloaded a file of images and inside it were Cat A images that he didn't know were there. The police said it hadn't been opened. He was charged with downloading those Cat A images anyway. Yes, it's a nightmare and a very very long one too. X

It's scary that it can be so easily shared without you knowing. It's really opened my eyes about being online now. I'm not naive or anything but people's stories on here are really eye opening ???? x
