Need some help as I am stuck wondering constantly x

Hi everyone.... I’m reaching out because I’m feeling really stuck and unsure about where we stand. My partner was arrested four years ago, and two months ago, after all this time, he was called in for a voluntary interview. Since then, we’ve been waiting for a decision on whether he’ll be charged. I’m just wondering, how long does it usually take to hear back?

Here’s the situation.. The police seized three devices back then, his phone, laptop, and iPad. They only forensically examined the phone, and found 1 Category B moving image, which is a screen recording of a video chat. The problem is, my partner has never seen this video and has no idea what it is. He hasn’t communicated with anyone in the chat either. During that time, his phone was just around the house, and the laptop was his main device, so it’s possible that someone else had access to it. He’s been very clear that he didn’t use the phone to do anything illegal.

The police questioned him about an Instagram account related to the video. The account in question was a publicly available one, which my partner could have easily proved. But the issue is, the account has been suspended for over 2 years now. Meta’s policy is to delete data after 2 years, and since the police didn’t contact Meta earlier for more information, we can’t retrieve anything from that account. Now we’re stuck with no way to prove his innocence through that account, even though it could have easily shown that he wasn’t involved.

To make matters more confusing, the police didn’t even examine the other two devices... the laptop and the iPad. They said the laptop was “too beat up” and that the iPad probably didn’t have anything on it since it was a university-issued device. They offered to return the devices, but we’re still waiting for any clarity.

It’s been two months since the interview, and we still don’t know if they’ll move forward with charges or not. I’m just wondering, does anyone here have experience with something like this? How long did it take for you to hear back? If charges are filed, how long before you go to trial?

I’m really trying to stay strong for the kids, but this whole process is exhausting. Any advice or shared experiences would mean a lot. Thank you ??

Sorry you're here and going through this. I can only share my experience.



the knock came early last year. On the day the OIC kept on saying "did you stumble across it by accident" my husband said from day one that he never went looking for it and never asked for it. It was sent with adult images. Majority were Cat C and one was Cat A and the cyber report proved he was telling the truth. It was all on his ipad. They also seized his phone but nothing was found on that but he's never got it back.

The day they came to the house they took my phone, his phone and the kid's phones. They also checked my laptop and my son's laptop just in case he had access to those. Me and the kids got our devices back within a few hours but they obviously kept my husband's devices.



the timeline for us was as follows:

the knock

april 2024 bail hearing

April 2025 preliminary hearing

May 2025 Hearing and sentencing



he was given community payback order and placed on the SOR for 3 years

I am so sorry you've been through this as well but also happy for you that at least it was over and done with and you can all take the time to heal and move on

At least police dealt with your case swiftly... My OH is now waiting almost half a decade and police clearly do not have enough evidence because by now it would have been sent to the CPS

Not sure what more they want because there is nothing left to find they did the forencis already x
