changing children’s names?

this is my first post. ex was arrested in dec 24. we have 2 toddlers, his phone is yet to be searched or any news. he is adamant that nothing will be found on his phone.



if nothing is found then i believe his innocence 100% we will work towards being a family again.



if not, i want him out of our lives. basically i want the children to have no association with him. am i able to take him off the birth certificate? more importantly, change their names to my surname?

Sorry you've found yourself here - it's not a fun place to be but you will find nothing but support in this forum.

i had a quick check online - it's not possible to remove him from the birth certificate if he is the biological father.

it is possible to change their name if all those with parental responsibility consent. I'm assuming he has parental responsibility? If he does not consent you would need to consult a family lawyer and apply to court - even then consent may not be granted - I suppose it would depend on the severity of the crime (assuming there is one).

Sorry you find yourself in this (rubbish) club.

I don't think you can take a man off the birth certificate unless he's not the biological father? I may be wrong but I worked in a Solicitors Office for a while and I'm sure that was the law.

As it stands in law at the moment, no, you can't remove him from the birth certificate. You can change names but you'd need his permission until they're 16 I think as he's got parental responsibility.

As he's on the birth certificate he has PR.

This is just my own personal opinion but if it turns out that he's guilty, will it be in the best interest of the children to block all contact, even supervised in a centre? I know my children wouldn't have thanked me if I'd done that to them. My children were blocked by SS's from having any contact with their Dad and it was devastating and extremely harmful.
