Change in bail conditions

We're heading towards our third bail extension, and 9 months since The Knock. The inlaws have paid for a solicitor now to see if we can get bail conditions changed so my person can come back home. He's currently sleeping on a 2 seater sofa and his mental health is suffering badly. The initial social services report deem him not to be a risk to the kids and I know that he's not. Has anyone had any experience, good or bad, of what happens if and when bail conditions are removed? We want this whole situation over will so we can start to mend and move on, but the police have said his devices are nowhere near being looked at yet x

Hi

We have just had the first extension to bail conditions. The extension was given as the police are no further forward and devices not even be looked at yet, which is frustrating in itself.

We are just completing risk assessment with SW and from conversation with them and police I am hopeful we can get the bail conditions changed. Having him home would help as a first step, but while there is still no unsupervised contact it makes my life so difficult juggling school, working full time, outside activities... and all this while SS tell me to look after myself... when am I supposed to fit that in?

I'd be interested to also know any positive caes that might give me hope.

I understand everyone is doing their job, but the length of time that this goes on and ultimately not currently charged with anything, it all feels a lot on all of us, but in particular me who is taking brunt of it all.

Confused19, I remember our first 3 months and it was just awful so I now what you're going through, as do a lot of others on here.
It was 62 days before SS had done what they needed to before my person was able to see our child and it was the longest time of my life. Like you say, they tell you to look after yourself, but that it easier said than done with trying to navigate this new situation and be the strong one.
Keep going though because it does get easier and it will all become the new norm xxx

When my OH was on bail from june- december. He wasn't allowed any access to u18s unless otherwise avoidable in everyday life. When december came around the OIC said they cant bail anyone for more than 9 months without asking court or something like that. He was then moved to RUI. He was then allowed supervised access to children. May be different though as we dont have any children ourselves, it was just so he could see his niece and nephews at his parents house. He was told that it must be supervised though, as the OIC didnt want to have to get a court order if he wasn't following it but he would

His solicitor has explained that if he gets RUI, the police have a open ended date to have to charge or not, whereas if bail conditions are dropped and bail just extended, then they actually have to do something. We want it over and done with so are pushing just for bail conditions to be dropped. We've been told our local police forensics currently have a backlog until March 26 at the earliest so we're a long way off getting to the end of our journey yet x

I wouldnt put any kind of time frame on it... I only say this as my OHs devices were sent off September 2024 and we were told they wouldnt be back for at least 12 months and even then we would be lucky... more likely to be up to 15 months. They were back by April 2025. Now although this is good in a sense at least somethings happening I suppose I felt I had longer just living in ignorance... now we are back to the trauma of it all!

Many of us find that the police agree to RUI once they have to attend magistrate's court to get a bail extension. It feels as if once they have to account for how long they are taking with an investigation in the public domain they would rather avoid that. Before then you can certainly try and get the bail conditions dropped but it's not likely.

We did ask our son's solicitor to contact the police saying the conditions were disproportionate but she predicted accurately that the police would say 'tough' and next step would be her taking them to court at a huge extra cost for our son. As we also knew that if she succeeded and he wasn't on bail then SS would be far more involved and expect us to comply voluntarily with the bail conditions anyway. So we sat tight and at the next bail extension date (a few weeks after the solicitor's intervention) the police changed it to RUI anyway. We will never know if it was because they now knew our son had someone offcially representing him or if they would have done it anyway!

SS then created a new Circle of Safety for our grandchildren and where, for our son, it had just said he had to comply with bail conditions, now it specified exactly the same as his bail conditions. Admittedly it wasn't legally binding now but to ignore it would have implications for our son.
