Smart TV
Notifications OFF
My friend is in prison, because he was searching for films, and illegal images came up. Does anyone know if this can happen on a smart TV, a I am totally confused how he did it. I thought smart TV were safe, but he said it was easy. If so, then that means this could happen to anyone. Surely if these images are there, and he hasn't paid for them, it is not his fault.
Any advice would be helpful please

Sorry to be the bearer of bad news. Someone may correct me if I'm wrong but it's very hard to prove "I didn't ask for or know it was there". Unfortunately I don't think that's how the law sees it. You can access the internet and a lot of apps from a smart tv. Most of this stuff is on very common social media, chat and file sharing sites although there are some known for their "dodgy" side. Apparently you're only ever 3 clicks away from this type of thing on the internet. It's the responsibility of the adults using the internet to make sure they put restrictions and safety on devices so they can't access and block these types of things and to report anything they find.
Did your person report it and delete? What app were they using/watching?
As awful as this sounds a lot of people are ashamed and in denial and will often minimise what they have done. So unless they can prove and have evidence they didn't look for it, reported and deleted they are still likely to have to go through this process.
"I didn't ask for it" isn't enough of a defence unless you can prove they didn't know about it or had access to it. This often needs an expert digital forensics to dog all of that data/history. Just having this stuff available on your devices is illegal. They will likely take devices and look at internet history and if anything else is found it will also be used to support the case that they were actively looking because it shows a pattern of behaviour.
Hopefully someone on the forum can give you examples of cases where it didn't come to conviction but I think there extremely rare and by the point of Court the damage is already done.

Hi, if you email Lucy Faithful they have a really good and detailed explanation around this. I became quite paranoid around using the internet but LF assured me that the illegal stuff usually finds it way because the offender is already in a illegal space. Usually. Obviously every case is different. I really don't think you need to be concerned about the "normal" use of a smart TV but maybe others have some other information.

It might be of interest to you but with my ex was first arrested, he'd downloaded grade A images along with grade B and C but he didn't open the grade A ones. He was still convicted on downloading them though.
