Help, called for second interview

Hi all

My OH is called for second interview can anyone please let me know why is second interview required ? What will be asked in second interview?

A second interview is usually held when there are developments in the investigation and the police have evidence they want to discuss. It might be worth taking your solicitor with you, if you already have one.

Usually if you had devices sent off then its to discuss what was found on them

Occasionally it is to charge the person but it's more likely to indicate that the police are still assessing the situation and haven't yet decided on charges, or that new information has emerged. It might sound friendly and optional but if ignored the police could rearrest the person and bring them in for the questioning. It is more 'user friendly' in that you can negotiate the date for the interview to fit in with other commitments so don't feel obliged to accept the date offered if it clashes with work or something else of importance although of course being agreeable is always the best option. It is important to have a solicitor present despite the police making out it's just a friendly chat and the person has the right to remain silent so having legal advice is important.

When my person went to his second interview the police had the duty solicitor there. My person didn't get his own solicitor until he'd been charged.

My OH had his solicitor present at his 2nd interview and was advised to go 'no comment' which he did.

Evidence then went off to the CPS.

The CPS look at the evidence provided and decide whether they have sufficient to prosecute

So this might be last interview before moving to CPS?

I am scared now as CPS might charge him not sure why police have to have second interview

Yes this could be the last interview before evidence is sent to the CPS.

Bearing in mind that all cases and police forces are different, it might be wise to prepare for a bit of a wait after a 2nd interview for things to be sent to the CPS. Our son had an interview (his 3rd actually) last October and was told that now things could be sent off to CPS as the investigation was finished, but that didn't happen until about a month ago so we had months of waiting in trepidation. Of course your case might be much much quicker than that so fingers crossed for you xx
