hi guys



so it's been 19 months now since the knock on my OH was arrested after being caught in a police sting since this has happened. He has had therapy and has completedsome online courses with the foundation but what I would like to know is because it's a second offenceis he likely to be sent to prison. the police have said when he was arrested that they are going to be referringhim to Crown Court so does that mean he's likely to be sent back to prison? I'm still feeling very muddled and confused with the whole situation please somebody if you have any idea Please let me know what you think Thank you guys x

I haven't been in this situation so firstly I just want to say I'm so sorry you find yourself here.



the only thing I can say is with our person we were in magistrates court and his solicitor said they would have preferred him to be in crown court, as in magistrates this seems like the most extreme crime but in crown court it's one of the lesser impacting ones.

A second offence does increase the chances of a prison sentence, particularly if he is still on the SOR from the first offence. But crown court does not really alter the chances, although they can impose longer sentences than magistrates.

I can only tell you from my experience. My ex was sent to prison for a first offence of downloading and distributing all grades of abuse images. He reoffended and has just been sent to prison again for much less. This time was possession "only" of PSEUDO images.

My advice would be to prepare for the worst, hope for the best. He needs to take a bag with him on the day of sentencing just in case. In particular he should have everyone's name, address and phone numbers of those he wants to keep in touch with. He should take some cash too to put on his prison account so that he can phone from there. Wishing you all the best. X
