14months from arrest now have charges. And plea hearing in 2 months. Distributing /possessing 14cat a. 8 b. 2c and 1extreme image.
Could my person avoid going to jail, it is his first offence. But I understand the severity of distributing cat A. Any advice would be very much appreciated as things are moving quicker now.
Sorry to anyone I haven't got back to, been a long road x

My young person had more than that across the board over 100 and avoided jail its just a really rough and tough situation to be in an no one will ever u derstand unless it happens to them and id never wish it upon anyone xx
Most image offences receive either a suspended sentence or a community order. The number of images is not considered as important as other factors and 14 is a very low number nowadays.
I understand on one level why the number isn't hugely taken into consideration, but it's still slightly frustrating. My now ex had 8 deleted images, all from the same date, but because one was a Cat A he will quite likely be charged for possession of Cat A just as if he had hundreds of Cat As spread over a significant period of time (he claims the file was unsolicited, but who knows). I'm furious & disgusted with ex, but even I have some 'sympathy' with him on that one.
I think it's unlikely. They would only consider jail at this point if they believe he was a danger to society. It's usually like others have said a suspended sentence (which if they break they then go to prison) or community order.
Judge said they wanted to make an example of my husband - 21 month sentence for approx 200 images.
Hope you don't mind me saying, Anxiousgirl, but you have been on the forum for quite a while, so with the current situation in jails being so full and such awful backlogs, things might be a little bit different at the moment. Obviously no guarantees at all of course and all we can do is cross our fingers and hope for fairness and the judge not to be in a bad mood.
My young person is still waiting to be interviewed so it's known yet what he has got. Its a 2nd offence and im angry with him but so stressed that he will go to prison. He is autitustic and the loveliest person yiu could meet. This is so out of character and even he doesn't know why.
It shouldn't be a lottery. The whole criminal justice system is a farce. It's only when you are stuck in it that you realise this. My Son has his PSR next week and I can't seem to get a straight answer from his Solicitor - will the Probation Officer get sight of all the reports and supporting statements, including the Psychiatric and Psychological reports which will provide mitigation?
I've decided I am taking them myself and not taking any chances !
