When you finish SOR

Hiya team.



Not been here for a while.



So we are now in our third year of my O/H being on SOR and two to go.



Now he probation said to him it's 5 years plus 1 which he thought was unfair. Now I read somewhere on here that that is not happening now.



Anybody have the link ???? for that please.

It all depends on the sentence and if there is an SHPO. I think probation are mixing this up with when a conviction is spent, which is length of sentence plus one year, unless there is an SHPO in place.

I thought the conviction was spent whenever the sentence ends or the SHPO ends, whichever is longer?

So if a 3 year community order is given without a shpo the conviction is spent at the end of the 3 years, whereas if a 2 year community order is given but a 5 year SHPO is given alongside, it's not spent until the end of the 5 year SHPO?

So O/h got a community order and on SOR for 5 years and got got 240 hours community service and SHPO.



I read somewhere on here that is went to law that as soon as the SOR is over then that's it non of the extra year rubbish.

In your case, it is over after 5 years, assuming the SHPO is also for 5 years. Check the Unlock website if you want more details.

Hi Chelsea,

my person received a 3 year community order which finishes next January and 5 years SHPO and register.

The SOR ends in 2027 but the conviction won't be spent until January 2028.

When he asked whether the DBS updates the records immediately after a conviction is spent he was told by both his P.O and Visor that they didn't know!!!- it astonishes me that so called " professionals " are so completely unaware of these issues

I don't think that is quite right. If the community order finishes in January 2026 then it would normally be spent one year later in Jan 2027. But the SHPO extends this to Jan 2028, in which case his time on the SOR would also be until Jan 2028.

There were changes to when convictions are spent. The plus one year doesn't apply anymore but if there is a relevant order, in most cases on here a sexual harm prevention order, the conviction becomes spent at the end of that order. My partner for example in February 2021 was given a 3 year community order, 5 year SOR and 5 year SHPO so his conviction will be spent in February 2026 xxx

Thanks distressed and pregnant, I thought that was the case. We avoided a shpo and the updated info online is that the conviction is spent as soon as the community order is done without the extra year thing.

We are going to apply for a basic DBS somehow shortly after to see whether it appears or not...
