Hi

i am a bit of a mess today, really bad day for me. One of them where all you want to do is cry scream and shake every person that has lied so far in the process and we are very early days. All we want is consistency and the truth from these organisations, not lies and false promises but thats all we are getting. I mean I think I need a solicitor present at every SS meeting and any conversation with the police. As it is their word against ours and no consistency from one person to the other asking the same question. Aghh.

Sorry just needed that rant...

My reason for posting is whist we are along way off Court,I seen a case recently where the person is allowed no contact with anyone under the age of 18. I am assuming this does not affect their own children?

I am just concerned now that my OH when sentenced that he cant see his own kids if this applies?

Thanks and I really appreciate everyone's help on here. A few of the recent cases I read there is mental health issues and I think this probably applies to quite a number of the men affected by this as they do not talk. I just wish there was another way to help them other than all this. Cause it affects not only them but us. It is so sad.

As I understand it if a condition of the SHPO is no contact with under 18s that does include their own children unless the court have specifically stated that it does not include them.

But would it mean supervised contact permitted or no contact at all?

Seems very harsh if no contact at all?

It's all going to come down to how the court order has been worded but if it says no contact with under 18s I would take that as meaning no contact full stop with any child.

I'm sure some people on here have said that their person has SHPO conditions which include no contact with under 18 but the order includes an exemption for their own children where supervised contact is permitted in line with social services

Hopefully someone who's person has a SHPO in place can give you a more concrete answer.

The bail sheet should delineate the requirements . Can you check what is stated there?

As far as I know it does affect your children.

My daughter's husband is only allowed supervised contact and 10 days after sentencing we're still waiting to see how that will work as no-one has been in contact yet.

Hi,

I think the key thing to remember is that the SHPO should be proportionate to the offence. The solicitor should get a copy of any proposed SHPO before sentencing and it can be challenged. The no contact clause is usually worded as no unsupervised unless agreed to by SS or the parents. My partner doesn't have a no contact clause, his SHPO is online restrictions only and he has always had supervised contact with our daughter. We were given the ok by ss in February to begin unsupervised contact as we see fit xxx
