Blackmail charge?

Hello,

My person's case is moving along and we are 10 months post knock. He has had bail moved for the 3rd time and the device is being looked at over the coming weeks.

I am confused though, so the crime was done through an app and the information came from the other person to the police and so my person was arrested. Unfortunately the other person sent a photo and then my person tried to force them to send more which has been recorded by the police as blackmail and/or harrassment which is upsetting. Four years ago my person was a victim of this behaviour online as well and was blackmailed to send money and gift cards to stop a photo apparently being spread. Do we mention this to the police now? At the time we were horrified and the channels that are out there now to contact police weren't then, so we supported as best we could.



My other question is what does blackmail or harrassment come under? And if they don't find any iioc, can they go further with this investigation?

Just wanted to chip in here as we are in a similar case to do with interpreting someone's behaviour - the police and CPS will use the worst interpretation possible but the key word here is 'motivation'. To qualify for being blackmail would depend on how your person tried to get them to send him more and the specific wording used. Did he use threats and/or menaces? This is probably where you do need to get some professional advice and often it feels easier to just accept the accusation even if it's not exactlyhow it was. Happy to private message you about our situation as we have just had our plea hearing and all this was the first we had heard about challenging the wording used and its implications.

Just to add, if it's only the police saying it's blackmail try to wait until you hear back from the CPS as the police will throw words around which really freak us out but might actually end up meaning not all that much in the grand scheme of things.
