So we had the knock Monday just gone. My partner was taken for questioning on distributing iioc. He admitted to what he had done, he had forwarded 1 video and 1 image on kik to another user cat b & cat c. This image and video was never downloaded onto his phone just forwarded straight in the app.

He said while I had been watching vigilante group videos on facebook he overheard that there was groups on kik, telegram and things like that. He thought he could go on and maybe try doing what these hunting groups were doing and didnt realise he'd gone the wrong way about it until the knock at the door. The offence took place back in December.

He has been bailed to appear again in December with conditions to not have any unsupervised contact with anyone under 18. We have a little girl together who is 4 and his entire world as he is hers so this has been extremely difficult.

His phone has been seized for forensic download so thats just a waiting game now. The OICA said if nothing is found on his phone (he swears there is nothing on there) then it will likely be NFA.

Just wanting any advice really on what to expect. Any similar stories. Just anything I guess.

I'm sorry that you have had to find yourself on here.

If what you partner has said is true it would be quite an unusual case, I can't recall having come across anything similar on here. Closest I can think of is a communications offence where the person said that they knew they were talking with a decoy and was playing along/goading them.

That said if the police can prove possession or distribution then him saying he was attempting to catch others is unlikely to be a suitable defence.

I think it goes to show just how close to the line the vigilante groups are to breaking the law themselves to catch those breaking the law.

26a20 - in my experience, the Police, solicitors, barristers and courts all say they dislike vigilantes intensely but yet they enable them to carry on operating within an inch of the law. I don't think people realise until they have been at the other end of the vigilantes actions just how close to the wind they sail. They are the dregs of society who operate more for their own sick self interests than for the 'children' they claim they are protecting, Sorry, rant over !

My person is in a similar pickle. The number of images is really small and they're all Cat C plus there's no communication offences, so it's overall a very weak case against him.

It's incredibly frustrating especially considering there are so many violent criminals wandering the streets while he's being investigated over some stupid bikini pics!

I hope for both of our sake they both get NFA but get this: I only recently learned that even a NFA stays on your criminal record permanently! Or 100 years at least. It can still affect your life if you want to travel to the US for example. So it doesn't wipe the slate clean after all.

That means even if someone makes completely false accusations about you and the police realise it's not true either, your permanent record STILL is tainted for life. You can technically appeal to have it removed but that's not a dead cert either.

Our country treats people as guilty until proven innocent and it's a shame.

Just for you to know a family member got NFA and they successfully obtained a visa to live in the US. So though it does stay on your file, it does not show on a police certificate that the embassey asks for. Hope this helps. X
